One of the Deputies working for Marshal Will Doane, Harvey is apparently one of Marshal's best men - but that doesn't stop him following the Marshal's lead when the odds against them become too great.

When Butterfield tries to convince them to stay, Harvey argues in the Marshal's favour.
"We got families!" reasons Harvey. "Everyone of us is a family man."
"I'm a family man too," Butterfield says.
"Then you best get out like the rest of us," the Marshal warns.
Taking out their guns, Harvey, Will, and the other deputy, Sam, go outside.

They walk out onto the porch of the bar and lay down their guns. Wade's gang don't play by the rules of honour and the trio are soon mercilessly fired upon.
